National Poker Lobbying Day – May 24th, 2011

On May 24th, 2011, the Poker Players Alliance (PPA) will be holding an emergency “fly-in” to Washington, D.C., to make the case for regulated online poker in the U.S. Approximately 30 of PPA’s State Directors will meet with targeted lawmakers and ask them pass legislation to license and regulate online poker.

We hope you can join this effort. We are asking our entire membership to meet with their congressional delegation on this day either in Washington, D.C., or in the state district offices for their federal lawmakers.

The PPA will be providing the tools and information you need to arrange and execute those meetings either in Washington D.C. or back home in your congressional delegations district offices. We encourage every PPA member to meet with their members of Congress on May 24th and request that if you secure a meeting to please email the national office at dcflyin@theppa.org and let us know the details.

Where Can I Play Poker Online if I am from the United States?

With the recent developments in online poker, there are many online poker players from the Unite States who are looking for places to play.

I would like to start by quoting a lawyer in regard to the legal ramifications of playing poker online if you are from the US.

Here is the statement:

Players who use the sites can’t be prosecuted under federal law and the U.S. states that have laws against making bets rarely use them against “mere customers,” said I. Nelson Rose, an Encino, California-based consultant to governments and industry on gambling laws.

“I’d say there’s a probably a better chance that they’ll win the World Series of Poker than that they will be arrested,” Rose, who doesn’t work for any of the companies named in the indictment, said today in a phone interview.

With that being said, I believe there are still some good options for US based online poker players.

We have been contacting various online poker rooms to get their reaction to the recent seizure of the PokerStars, Full Tilt and UB.com domains. Below are some statements that we have received so far.

Carbon Poker, PDC Poker and Aced Poker issued the following statement:

“To keep things short and to the point, – It’s business as usual around here!”

They have assured me that US based poker players funds are safe at any of these poker rooms. They have said that they are still letting US based players on real money poker tables. In addition, they have said that they are processing deposits, transfers and withdrawals for US based poker players.

Lock Poker has issued the following statement:

“Lock Poker is staying in the US market. US funds are safe at Lock. Deposits, transfers and withdrawals are all going as fast as usual.”

“Cake Poker is not a party to any ongoing US legal proceedings and it’s business as usual.”

We are also waiting on statements from several other online poker rooms in regard to their policy on United States online poker players.

I have personally been playing on PDCPoker and have been able to play any real money game at their room. I have not tried to process a withdrawal since April 15th, but I will in the next several days. I will keep you updated on what is going on at PDCPoker.

We will have some additional information on this situation as soon as we receive new facts.

UB.com Response in Reaction to Recent Seizure of Domain

We have received a statement from our affiliate manager at UB.com:

Currently the information I have on the AP / UB situation is US players are blocked from registering and US players cannot make a deposit, withdraw or transfer from their accounts.

However, please note that US traffic will be blocked from registering.

Full Tilt Poker Being Investigated by Grand Jury in Manhattan – Kentucky To Sue Online Poker Sites

Full Tilt Poker Grand Jury Investigation

It has been reported that a federal grand jury in Manhattan is investigating Full Tilt Poker. Allegations of money laundering violations seem to be one of the biggest concerns according to information in an article in the Financial Times. Chris Ferguson and Howard Lederer seem to have been specifically targeted by this probe and could possibly face indictments.

A company spokesperson for Full Tilt Poker said that reports by Financial Times regarding an alleged Manhattan grand jury investigation is news to them. “We are not aware of any grand jury investigation of Tiltware or any related individual or entity, and the company’s position is that it has done nothing wrong. We are not going to comment about a speculative grand jury investigation that we are not aware of and we have no idea what, if anything, they are investigating.”

Kentucky Tries a New Angle on Legal Issues with Online Gambling Domains

Kentucky has been in the news in regard to their attempt to seize 141 online gambling domains and now it seems they are also trying a new angle. They are claiming that Pocket Kings owes them monies “lost between March 25, 2005 and September 25, 2009 by persons located within the borders of Kentucky.”

Pocket Kings is the owner and operator of Full Tilt Poker, which is one of the domains being targeted. The court filing calls for Pocket Kings to refund the state of Kentucky “the amount of money lost between March 25, 2005 and September 25, 2009 by persons located within the borders of Kentucky,” as well as any legal costs.

It has been recently announced that they have decided to sue Full Tilt Poker and other online poker sites including Absolute Poker, UltimateBet, Doyles Room, PokerStars to name just a few.

“The Full Tilt Defendants have done, or have caused to be done, tortuous acts in the Commonwealth for which the Commonwealth has a substantial and compelling interest in exercising personal jurisdiction,” the comlaint says, using an oral statement made by the IGC before an earlier court of appeals hearing that over 13,000 people in Kentucky play online poker.

An Online Poker Player’s Feelings on the Legal Issues with Online Gambling

The United States really needs to get a grip when it comes to regulating online gambling, especially poker. These claims and allegations seem to be a way for states facing huge deficits to try and fleece some money from online poker sites to try and plug the holes in their budgets. These are frivolous claims as far as I am concerned and it will not stop me from logging on to PokerStars, Full Tilt Poker or PDC Poker anytime I may be in the Commonwealth of Kentucky.

If you are an online poker player, do not let these states influence how you feel you should use your hard earned money. I believe that sites such as PokerStars, Full Tilt Poker and PDC Poker should be applauded for continuing to allow players from the U.S. to play poker for real money on their sites. Be assured that you can continue to deposit and withdraw real money from these sites as well as several others including UltimateBet.
