With the recent passage of the Unlawful Internet Gambling Act, there was a lot of confusion. Many online poker players assumed that they are not allowed to play poker online anymore. This is not true. The new law does not make online poker a crime.
Much of the confusion was caused by the announcements from Party Poker and Pacific Poker. They both have stated that they will no longer accept US poker players. Party Poker (PartyGaming) and Pacific Poker (888 Holdings) are both publicly traded companies. As a member of the London Stock Exchange, they have to abide by certain regulations. A publicly traded company can not violate any law in any jurisdiciton where they operate. Therefore, Party Poker and Pacific Poker have made the decision not to accept any more US players.
Other sites have reacted differently. UltimateBet made a big move a day before the new bill was signed by President Bush. They changed from a publicly traded company to a private company. This allows them to continue to accept players residing in the United States. I tip my hat to UltimateBet for making such a gutsy move. In response, I made a $100 deposit at UltimateBet to show my support for the company. I have always liked UltimateBet and they were actually the first poker room that I started to play at. Do any other people feel that UltimateBet made the right decision? Would you play poker online at UltimateBet?
Poker.com has stated that they will continue to accept US poker players. Their official statement includes the following:
"We want to assure you that Poker.com is legally regulated and licensed to offer it's services to anyone around the world and that your day-to-day experience at the site will remain unchanged in all respects for the forseeable future. All player account funds are 100% safe and secure and you will always have access to these funds."
I was quite relieved to hear that Poker.com would continue to accept wagers from US players. I have a decent bankroll at Poker.com and enjoy playing there every day.
Other online poker rooms have also stated that they will continue to accept US players. Full Tilt Poker, Doyles Room, Absolute Poker, and Poker Stars have all stated that they will continue to accept US poker players. I was waiting for a response from Poker Stars, as I felt that their reaction would have a big effect on online poker. If Poker Stars does not accept US players, there would have been many poker players that would not be happy. Poker Stars recently stated that they will continue to accept US poker players.
One of the things that all the online poker rooms which have backed out of the US market have in common is the following: they are all publicly traded comanies.
Poker.com is not a publicly traded company. Poker Stars announced that they would delay their Initial Public Offering on the London Stock Exchange. This allows them to continue to accept players from the United States.
In light of statements from FirePay, it will be more difficult to fund your online poker account. However, NETeller is currently still processing funds to a poker account online. I just made a deposit about a week ago. FirePay stated that they will no longer process payments from or to an online gambling site. Oh well. I believe that there will always be a way to fund your online poker account. If totally necessary, you can even send a check to fund your online poker account.
Keep in mind that playing poker online is NOT a criminal act. The new applies to banks and financial institutions. It is safe to say that you will not have law enforcement at your front door if you continue to play poker online.
I would urge all online poker players to go to Poker Players Alliance and sign up. They are a non-profit group who is supporting online poker. Please check out their site and join all the other poker players who have become members.
